Court confirms: domestic intelligence agency may escalate AfD Lower Saxony

The Hanover Administrative Court has rejected an emergency motion filed by the AfD state association and thus given the green light for the provisional escalation. The court sees a constitutionally hostile overall picture in the AfD Lower Saxony, as evidenced by court documents.

The classification as "observation subject of significant importance" is an intermediate stage: it allows the domestic intelligence agency more intensive surveillance, but does not yet fall under the highest category of "right-wing extremist". The state association may appeal the decision, which could prolong the proceedings further.

Court sees constitutionally hostile orientation

The court argues that AfD positions are at the borderline of criminal liability, without crossing it. Judges assessed statements by party officials and the overall program as evidence of a constitutionally hostile orientation. The party had argued that such a classification violates its fundamental rights and is based on political persecution.

The Lower Saxony domestic intelligence agency had requested the escalation after concerns about the ideological orientation of the state association had solidified. The decision is part of a nationwide debate about the monitoring of the AfD by intelligence services – several federal states are considering similar steps.

Political setback for the party

For the AfD, the classification is a political setback, even though it does not yet represent the harshest category. Party officials announced they would exhaust all legal remedies.
