Court blocks Pentagon plan to remove transgender soldiers

An appeals court has ruled against the Trump administration in a partial decision and blocks the removal of 28 transgender soldiers from the military. The court found that the Pentagon's order to discharge these soldiers was unlawful and granted them provisional protection while their lawsuit continues.

The judges were divided in their decision, however: while they maintained protection for already-serving transgender soldiers, they allowed the government to exclude transgender people from new recruitment. This split ruling creates an unequal situation – active soldiers may remain, but potential recruits are turned away.

Plaintiffs demand expanded protection

The plaintiffs announced they would ask the court to expand protection to all transgender soldiers. They argue that the recruitment ban also violates constitutional rights. The court will have to address this question as the main lawsuit proceeds.

The decision represents a provisional victory for the soldiers challenging the policy. But it also shows the limits of the protection: the court acknowledged that removing already-serving soldiers is problematic, yet allowed the barrier against new transgender recruits to remain. This leaves open the question of whether the Trump administration can enforce its recruitment ban long-term or whether further court rulings will block it as well.
